Beardstown family sues ICE and Beardstown Police Department PDF Print E-mail

A Beardstown family believes they were assaulted by local authorities and have taken it to another step by filing a lawsuit in U.S. District Court in Springfield.The lawsuit is against Immigration and Customs Enforcement agent Dwayne Haferkamp, former Police Chief Tom Schlueter, and other officers.
The plaintiffs are a 65-year-old mother, Ana Chavez and her four children, Jonathan, 28; Juan, 34; Alberto, 23; and Maria, 34. They are representated by Chicago Attorney David S. Lipschultz of Goldberg, Weisman, and Cairo. On the company website, Lipschultz is noted for his ability to sue police officers and municipalities on behalf of individuals who have been victims of false arrest, excessive force and malicious prosecution.
The incident occurred, according to reports, on November 13, 2012 when officers entered the home, used pepper spray, a stun gun, and handcuffed the family members and then left without arresting anyone.
In March, the Chavezes submitted a Federal Tort Claims Act claim to ICE, but the claims were denied.
