A Mt. Olive man pleaded guilty to two counts of attempted predatory criminal sexual assault of a child on Friday. Nolan Smith, age 73, entered the guilty pleas in Cass County Circuit Court. The pleas were part of a deal that dismissed four other charges, including three class X felonies.
The two counts Smith pleaded guilty to are class one felonies. Normally, these are punishable by between four and fifteen years in prison, but probation is also a sentencing option. The two counts are each for a separate victim in incidents that occurred in 2003 and 2004. The three class X felonies that were dismissed were three counts of predatory criminal sexual assault of a child. Under certain circumstances, these can carry a penalty of life in prison.
A sentencing hearing was set for March 10. Cass County Circuit Judge Bob Hardwick, Jr. will decide on a sentence at that time.
