A Mt. Olive man faces Cass County charges of sexually assaulting two children. Nolan Smith, age 72, and formerly of Beardstown, faces three counts of predatory criminal sexual assault of a child and three counts of attempted predatory criminal sexual assault of a child. According to court documents, the counts allege the assaults took place sometime in 2003 and/or 2004 in Beardstown. All of the victims were under age 13 at the time.
The three predatory criminal sexual assault charges are class X felonies. These are normally punishable by six to 60 years in prison but due to there being multiple victims, Smith could face a sentence of life in prison. The three attempt charges are class 1 felonies with a possible four to 15 year prison term.
Smith was arrested July 15 and has since bonded out of jail. He made his first appearance in court July 22 where he was advised of the charges. A preliminary hearing was set for Aug. 19.
